– what to consider when filing, prosecuting, and guarding your patent at the EPO
It is never too late – or is it?
Enlarged Board of Appeal (EBA) addressed the question about late filing of data to support credibility – and in consequence inventive step – in the well-known decision G2/21. But as always, also this decision leaves room for interpretation. Louise Aagaard has taken a deep dive into G2/21 and some of the decisions from Boards of Appeal following the EBA decision and will help us get an understanding of when too late is (not) too late.
Is the first rendezvous just a preparation for the second?
Once your European patent has been granted – late-filed data or not – it may very well face scrutiny before the Opposition Division because you have stepped on someone’s toes. How best to prepare, what are the watchouts and maybe in particular: is this first rendezvous with the EPO mainly a preparation for the second, namely the Appeal? Steven Kitchen and Axel Heimann will share their thoughts and prepare us for the first as well as the second rendezvous.

Louise Aagaard who is a European Patent Attorney, UPC Representative and Partner at Høiberg. Louise works within all areas of Life Science including biotech, pharma, food technology and green tech. Further, Louise is Head of Pharmaceuticals, Novel Foods & SPCs at Høiberg.
Steven Kitchen who is a European Patent Attorney and Partner at COPA. Steven regularly represents clients in opposition and opposition-appeal cases in the fields of mechanics, electronics, and software. Steven is also Technically Qualified Judge at the Unified Patent Court in the fields of electronics and physics.
Axel Heimann who is a European Patent Attorney, German Patent Assessor, UPC Representative and Partner at COPA. Axel mainly works in the areas of biotechnology and chemistry, but he has also represented clients in the mechanical field.
